1. About these Terms
These Terms of Service ("Terms") are a contract between Fly Explore Traveltech Private Limited (CIN U79110TS2025PTC207091), which operates Flyett ("Flyett", "we", "us"), and the business that opens a Flyett account ("Agency", "you"). They cover the Flyett platform at https://www.flyett.com, the Flyett web application and every related service (together, the "Service").
By creating an account, or by using the Service on behalf of a business, you accept these Terms for that business and confirm you are authorised to do so. If you do not accept them, do not use the Service.
These Terms work together with our Payment Terms, Refund & Cancellation Policy, Privacy Policy and Grievance Redressal & Service Delivery page, which form part of them. If they conflict, these Terms apply, except that the Refund & Cancellation Policy governs refunds and the Payment Terms govern payments.
2. What Flyett does
Flyett is business software for travel agencies and corporate travel teams. It lets your team search, book, hold, ticket, service and invoice flights, hotels, buses and visa applications, and manage customers, travellers, corporate clients, payments and reports.
Flyett is a technology platform. The travel services themselves are provided by airlines, hotels, bus operators, embassies and visa centres, and the consolidators that supply them ("Suppliers"). Their conditions, including fare rules, baggage allowances, cancellation and change rules and visa decisions, apply to every booking.
You can book in two ways:
- On your own supplier accounts: you connect accounts you hold with Suppliers. The booking is between you and that Supplier; Flyett provides the software and charges only its platform charges.
- On Flyett supplier accounts: Flyett obtains the travel service from the Supplier and provides it to you. The price shown to you as your cost includes every Flyett charge and applicable taxes.
In both cases you sell to your customers. Your customers and travellers contract with you, not with Flyett, except where Flyett collects a payment from them on your behalf as described in the Payment Terms.
3. Accounts, users and security
You must give accurate details about your business, including its legal name, address, contact details and, if registered, its GSTIN, and keep them up to date.
Your account owner controls who has access, their roles and their permissions, and is responsible for everything done under your account. Keep sign-in details confidential, turn on two-step sign-in for your team, and tell us at once at support@flyett.com if you suspect unauthorised access.
We may verify your business before activating the account or certain features, and may decline or limit an account where we cannot.
4. Your responsibilities as the seller
As the business selling to customers, you are responsible for:
- the prices, markups, service fees and cancellation fees you charge, and showing them clearly to your customers;
- giving customers the fare rules, baggage, cancellation, change and visa information that apply before they pay;
- the accuracy of traveller names, dates of birth, identity and passport details and contact information you enter;
- having a lawful basis, including consent where required, for the traveller personal data you enter, and telling travellers how it is used;
- complying with the laws that apply to your business, including consumer protection law, the DGCA Civil Aviation Requirements that apply to agents, GST and the Digital Personal Data Protection Act, 2023;
- the GST and other taxes on your own charges, and the invoices you issue to your customers.
5. Acceptable use
You must not:
- make speculative, duplicate, test or fictitious bookings or holds, or hold inventory you do not intend to ticket;
- use names, details or payment methods that are not the traveller’s or that you are not authorised to use;
- resell or sublicense access to the Service, or let anyone outside your business use your account;
- scrape, copy, reverse engineer or overload the Service, or try to get around its limits or security;
- use the Service for anything unlawful, fraudulent or that breaches a Supplier’s conditions.
Flyett may set limits on holds and bookings, block a booking that looks duplicate, fictitious or fraudulent before payment, and suspend access while we investigate. Where a Supplier charges a penalty, debit memo or similar charge because of a booking made in breach of this section or of Supplier rules, you must pay it.
6. Fees, payments and refunds
Fees, how bookings are funded, invoices, taxes and non-payment are covered by our Payment Terms. Cancellations and refunds are covered by our Refund & Cancellation Policy.
7. Data protection and confidentiality
Our Privacy Policy explains how we handle personal data. For traveller and customer data you enter into Flyett, you decide why and how it is processed, and Flyett processes it on your behalf to provide the Service, under the Digital Personal Data Protection Act, 2023.
Each of us will keep the other’s non-public business information confidential and use it only for the purposes of these Terms, except where disclosure is required by law.
8. Intellectual property
Flyett owns the Service, its software, design and content, and the Flyett name and logo. We give you a non-exclusive, non-transferable right to use the Service for your business while your account is active.
You own the data you put into Flyett. You give us the right to use it to provide, secure and support the Service, and to produce aggregated statistics that do not identify you, your customers or travellers.
If you send us suggestions, we may use them without obligation to you.
9. Suppliers and third-party services
The Service relies on Suppliers and on third-party services such as payment gateways, cloud hosting, mapping and messaging. Their availability, prices, inventory, decisions and conduct are outside our control. Flyett is not responsible for a Supplier’s failure to provide a service, or for a visa decision, but will help you pursue the Supplier where the booking was made on a Flyett supplier account.
10. Availability and changes to the Service
We work to keep the Service available, but it may be interrupted for maintenance, Supplier outages or events outside our control. We may add, change or remove features. Where a change materially reduces the Service you use, we will tell you in advance as set out in section 16.
11. Disclaimers
Fares, availability and Supplier information are provided as received from Suppliers and can change until a booking is confirmed or ticketed. Fare signals, predictions, rankings and suggestions in Flyett are aids to your judgement, not guarantees. Except as these Terms expressly say, the Service is provided "as is", to the extent permitted by law.
12. Limitation of liability
To the extent permitted by law, Flyett is not liable for indirect or consequential loss, or for loss of profit, revenue, business or goodwill.
Flyett’s total liability to you arising out of or in connection with these Terms and the Service, in any 12-month period, is limited to the platform fees you paid to Flyett in the 12 months before the event giving rise to the claim. Supplier fares, taxes and other amounts passed through to Suppliers are not platform fees.
Nothing in these Terms limits liability that cannot be limited by law, including for fraud.
13. Indemnity
You will compensate Flyett for losses, penalties and reasonable costs arising from your breach of these Terms or of the law, the data you enter, or claims by your customers or travellers about prices, fees or information you gave them.
14. Suspension and termination
You may close your account at any time by writing to support@flyett.com. We may suspend or close an account for non-payment, a breach of these Terms, suspected fraud, or where a Supplier or the law requires it. Where we can, we will tell you first and give you a chance to put things right.
Bookings already ticketed or confirmed remain subject to the Supplier’s conditions and to our Refund & Cancellation Policy. Amounts owed by either side remain payable.
For 30 days after an account ends, you can ask us for an export of your bookings, travellers and invoices. After that we delete your data, except what the law requires us to keep, such as invoices, which we keep for 8 years for tax purposes.
15. Governing law and disputes
These Terms are governed by the laws of India. Before going to court, each side will try in good faith to resolve a dispute through our grievance process for 30 days. Subject to that, the courts at Hyderabad, Telangana have exclusive jurisdiction.
16. Changes to these Terms
We may update these Terms, the Payment Terms and the Refund & Cancellation Policy. For a material change we will email the account owner and show a notice in Flyett at least 15 days before it takes effect, unless a change is required sooner by law or by a Supplier. The current version and its effective date are always on this page. Continuing to use the Service after a change takes effect means you accept it.
